AKTMLA - Terms and Conditions

Introduction

Welcome to AKTMLA, an online question bank platform for the Applied Knowledge Test (AKT) of the Medical Licensing Assessment (MLA). These Terms and Conditions ("Terms") govern your access to and use of the AKTMLA website, services, and content (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use the Service.

Definitions

  • "AKTMLA," "we," "us," or "our" refers to the owners and operators of the AKTMLA platform.
  • "User," "you," or "your" refers to any individual who accesses or uses the Service.
  • "Subscriber" refers to any User who has paid for and been granted access to premium content and features.
  • "Content" refers to all questions, answers, explanations, medical information, and other materials available through the Service.
  • "AKT" refers to the Applied Knowledge Test component of the Medical Licensing Assessment.
  • "MLA" refers to the Medical Licensing Assessment.

Subscription

Payment and Billing

  1. Subscription fees must be paid in advance for the selected subscription period.
  2. By subscribing, you authorize us to charge the applicable fees to your designated payment method.
  3. All payments are non-refundable except as specifically provided in these Terms or as required by applicable law.
  4. Prices are subject to change, but any price changes will be communicated to you in advance.
  5. You are responsible for all taxes applicable to your subscription (except for taxes based on our income).

Auto-Renewal

  1. Unless otherwise stated, subscriptions automatically renew at the end of each subscription period.
  2. You will be charged the then-current rate for your subscription plan.
  3. You may cancel auto-renewal at any time through your account settings or by contacting our customer support team.
  4. Cancellation will take effect at the end of your current subscription period.

Subscription Termination

  2. No refunds will be provided for any unused portion of your subscription period unless required by law.
  3. We reserve the right to terminate or suspend your subscription for violation of these Terms or for any other reason at our sole discretion.

User Accounts

Registration

  2. You must provide accurate, current, and complete information during the registration process.
  3. You are responsible for maintaining the confidentiality of your account credentials.
  4. You are responsible for all activities that occur under your account.

Account Security

Permitted Use

License

  2. The questions, answers, explanations, and other educational materials provided through the Service are the exclusive property of AKTMLA or our content partners.

Limited License

  1. You are granted a limited license to access and use the Content solely for your personal educational and exam preparation purposes.
  2. No right, title, or interest in or to the Service or any Content is transferred to you.

Disclaimer of Warranties

Medical Information

  1. The Content provided through the Service is intended for educational purposes only and should not be used as a substitute for professional medical advice, diagnosis, or treatment.
  2. AKTMLA does not guarantee that the Content accurately reflects the current AKT or MLA examinations.
  3. We make reasonable efforts to keep the Content up-to-date, but medical knowledge and examination requirements evolve continuously.

No Guarantees

  1. We do not guarantee that use of the Service will result in passing the AKT or any other medical examination.
  2. The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
  3. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

Limitation of Liability

  1. To the maximum extent permitted by law, AKTMLA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.
  2. In no event shall our total liability to you for all claims exceed the amount paid by you to AKTMLA during the 12 months preceding the event giving rise to the liability.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy describes how we collect, use, and share your personal information.

Modifications to the Service and Terms

Termination

Governing Law and Dispute Resolution

  1. These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles.
  2. Any arbitration shall be conducted in the English language.
  3. The decision of the arbitrator shall be final and binding on both parties.

Indemnification

You agree to indemnify, defend, and hold harmless AKTMLA, its affiliates, officers, directors, employees, consultants, agents, and representatives from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to:

  1. Your use of the Service;
  2. Your violation of these Terms;
  3. Your violation of any rights of another person or entity; or
  4. Your violation of any applicable laws, rules, or regulations.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by an authorized representative of AKTMLA.

Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt to assign or transfer these Terms without such consent will be null and void. We may freely assign or transfer these Terms without restriction.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AKTMLA regarding your use of the Service and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the Service.
